<p>The days when a small business could ignore the risks of having misclassified workers are over.&nbsp; Unfortunately, some employers improperly classify their employees as independent contractors to avoid the pain associated with having employees, namely:</p>

<li>Payroll taxes</li>
<li>Minimum wage or overtime requirements</li>
<li>Other wage and hour law requirements, like providing meal periods and rest breaks</li>
<li>Reimbursable business expenses employees incur in performing their jobs </li>
</ul>
<p>Additionally, employers don&#8217;t have to cover independent contractors under workers&#8217; compensation insurance, and are not liable for payments under unemployment insurance, disability insurance, or social security.</p>
<p>It&#8217;s true, the expenses associated with employees are high. However, the cost of misclassifying workers is even higher.&nbsp; If your contractors are determined to really be employees you will not only be required to pay the taxes and fees you should&#8217;ve, you may also be required to pay the employee&#8217;s taxes as well.&nbsp; Not to mention the stiff penalties and interest that can be imposed by both federal and state agencies for violating the various laws.</p>
<p>This is no small matter and is on the radar of every government agency out there, all of whom are anxious to find additional revenue sources these days.&nbsp; The IRS estimates that one in seven U.S. employers is guilty of misclassifying some of its employees, resulting in a loss of more than $4.1 billion a year in tax revenues.&nbsp; These days the question is no longer &#8220;if&#8221; you&#8217;ll get audited for employee misclassification it&#8217;s &#8220;when&#8221;.</p>
<p>For businesses facing an audit, the odds favor the IRS. A recent report found that 92 percent of the companies audited for &#8220;misclassification&#8221; were hit with significant penalties and assessed for back taxes. Between 1988 and 1995, the IRS audited more than 13,000 businesses, reclassified 500,000 of their independent contractors as employees, and levied $830 million in back taxes and penalties.</p>
<p>Making matters worse, sometimes the various agencies disagree.&nbsp; For instance, here in California there are several state agencies involved with the determination of independent contractor status:&nbsp; (1) the Employment Development Department (EDD), which is concerned with employment-related taxes, (2) the Division of Labor Standards Enforcement (DLSE), which is concerned with whether the wage, hour and workers&#8217; compensation insurance laws apply; (3) the Franchise Tax Board (FTB), which is concerned with state income taxes; (4) the Division of Workers&#8217; Compensation (DWC), which is concerend with worker&#8217;s compensation; and (5) sometimes even the Contractors State Licensing Board (CSLB), that also have regulations or requirements concerning independent contractors&nbsp; and it&#8217;s not uncommon for one to rule that a worker is an employee while another rules that the same worker is an independent contractor.</p>
<p>Because the potential liabilities and penalties are so significant if an individual is treated as an independent contractor and later found to be an employee, each individual working relationship needs to be thoroughly analyzed to make sure every single worker is properly classified.&nbsp; Now is not the time to group classes of employees together.&nbsp; Just because one of your workers qualifies as an independent contractor, don&#8217;t assume that all the others doing similar work will.</p>
<p>It all boils down to control &#8211; does your business have control or the right to control the worker both as to the work done and the manner and means in which it is performed? The IRS breaks control down into three categories:&nbsp; behavioral control, financial control, and relationship of the parties. It is very important to consider all the facts for every single one of your worker relationships &ndash; no single fact provides the answer.</p>
<p><strong>Behavioral Control </strong></p>
<p>These facts show whether there is a right to direct or control how the worker does the work.</p>

<strong>Instructions</strong> &#8211; if your business has the right to direct or control the work, even if you don&#8217;t actually exercise the right, it can lead to an employee classification.&nbsp; Here are a few examples of what&#8217;s considered control:

<p>You&#8217;d think that a written contract detailing that you and your worker agree that you are not creating an employer-employee relationship is all that&#8217;s needed, but unfortunately this isn&#8217;t the case.&nbsp; It may certainly help, especially is you subsequently issue a 1099 form instead of a W-2 form, but even this doesn&#8217;t guarantee protection.</p>
<ul>
<li>If you decide to classify some or all of your workers as employees, this is what you have to look forward to: </li>
<li>You must withhold income tax and your employee&#8217;s portion of social security and Medicare taxes. </li>
<li>You are also responsible for paying social security, Medicare, and unemployment (FUTA) taxes on your employees&#8217; wages.</li>
<li>You must file a Form W-2, Wage and Tax Statement, showing the amount of taxes withheld from your employees&#8217; pay. The Form W-2 is used by employers to:

<li>Report wages, tips and other compensation paid to an employee </li>
<li>To report the employee&#8217;s income tax and Social Security taxes withheld and any advanced earned income credit payments </li>
<li>To report wage information to the employee, the Internal Revenue Service and the Social Security Administration </li>

<p>QuickBooks handles W-2&#8217;s differently based on which payroll subscription you&#8217;ve chosen.&nbsp; There are three options available:</p>

<li>You do not have to withhold taxes from your independent contractors&#8217; pay.&nbsp; They are responsible for paying their own income tax and self-employment tax. </li>

<p>We’ve been renovating home for last 2 years including new roof. Same licensed and bonded general contractor for all work. He subcontracted the new roof. Now we have leaks and some ceiling damage. Contractor says roofers made mistakes but he tried to fix himself with his own crew with only limited success so far. <p>I want some information from anyone who has any knowledge of disputes between apartment owners/contractors and Direct TV. I recently ordered direct tv only to find out on the day of installation that I can&#8217;t get Direct TV because there is a dispute between the Apartment Owner/Contractor and Direct TV. I called Direct TV and they said that they can&#8217;t install because the owners/contractor won&#8217;t let them do what is necessary to get the best signal and that drilling holes into apartments might be the solution sometime. I called the owners/contractor and they said that they are willing to install the dish only if they put it where they want it. What is really going on here? Dish Network is willing to cooperate with the apartment owner/contractor but direct tv is not. The apartment owner has access to the control box. Something smells fishy. Either it&#8217;s direct tv, or the apartment owner/contractor. What&#8217;s going on?

<p>Nothing is fishy.  Attachments to a building are at the discretion of the building owner, not a renter.  It&#8217;s very normal for apartment dwellers to be denied satellite service because they do not have the freedom to install equipment on portions of the building that they are not renting.</p>
<p>In that case, you need to look at options for TV other than DirecTv, and there are several.</p>

<p>The term &#8220;freelance&#8221; comes from the works of Sir Walter Scott and refers to traveling knights offering their services in battle to noblemen for a fee. This colorful designation is now used for independent contractors who offer their services to companies but are not officially employed by them. The freelancer is free to work in whatever manner they would like in order to accomplish the task given to them.</p>
<p>It is easy to see the benefits to working for oneself. However, a freelancer must quickly learn how to run all the aspects of their business. Unlike employees, a freelancer is expected to calculate and pay their own taxes. This is difficult task, but there are advantages to this financial control.</p>
<p><b>What is a W-2?</b></p>
<p>A W-2 is a statement that an employee receives from their employer at the end of a year. It lists their gross wages, taxes withheld, insurance payments, and other transactions made between the two parties. The company has already sent the employee&#8217;s income taxes to the IRS and usually has paid some of the social security tax. The employee uses their W-2 to file their taxes for the last tax year. They may need to add additional income received from investments or independent work. The forms aid them in calculating their taxes and determining whether they owe taxes or will receive a refund.</p>
<p><b>What is a 1099?</b></p>
<p>A 1099 is a statement that an independent contractor receives from a company. It is simply a form showing how much the individual has been paid by the entity. There have been no taxes withheld and no other deductions. The freelancers are completely responsible for filing and paying their own taxes based on their income.</p>
<p>An employer of an independent contractor is required to file a 1099 form with the IRS if they pay the worker more than $600. This is so the IRS is aware that the freelancer is receiving wages and can make sure the taxes are paid.</p>

<p>Switching from receiving a W-2 to a 1099 may seem like a lot of added trouble during tax time, but there are advantages to having control over how the process. Those who pay self-employment taxes are subject to a tax rate of 15.3%. Those who make under $400 do not have to pay taxes at all. The rate is not flat. It is adjusted according to the net income of the individual subject to their filing status. An independent contractor uses the 1099 and other records to calculate their net income and taxes. This works much in the same way for those who file with W-2s, but the tax is not overpaid because of an estimate on the part of an employer. Therefore, the 1040 form a freelancer files at the end of the tax year will calculate the correct taxes for the calendar year without any overpayment. </p>
<p>The American pay-as-you-go tax system that requires employers to regularly make payments to the IRS on behalf of their employees also compels freelancers to make quarterly tax payments. Independent contractors who estimate they will owe more than $1000 in taxes over a year must complete a worksheet of four estimated payments and pay them throughout the year. Unlike those who pay taxes automatically, freelancers have the freedom to predict changes in working situation. If the estimate is wrong, the taxes can easily be adjusted upon the next payment or the end of the year.</p>
<p><b>Know Your Limits</b></p>
<p>Freelancers have to dabble in every area of business. Although issuing invoices and managing expenses becomes easier overtime, some tasks are not worth the effort. As a business grows, chances are the tax filing procedure will become more complicated. A freelancer with a booming business should know when to outsource work to others. Hiring an independent CPA to take care of the quarterly taxes is fairly painless if one can provide good records. Focus on finding a preparer who has experience with independent contractors. The small fee could end up saving money and a lot of extra work.</p>
<p>For day to day operations, an option might be to outsource your invoicing and receivables to a third party. Having an experienced firm bill your clients and do your collections may be worthwhile, as your time is better spent focusing on what you do best. <p>Those who freelance have complete control over their finances. They are allowed to file their taxes in order to take full advantage of their deductions and business expenses. <h2>Why Do Clients Distrust Contractors?</h2>
<p>If we start out with this question, what comes to mind? Where does this come from? Kind of like, which came first the chicken or the egg? I really believe that the person that holds the purse strings is one of controls the situation. So where do bad contractors fit in?</p>
<p>&nbsp;</p>
<p>A possible scenario of events that cause a client to distrust contractors or say that contractors are no good, starts with the client wanting a job done, and through whatever means calls several contractors in order to obtain estimates for their job. The customer then asks for a price for painting their house. Let&#8217;s say there are three contractors, these three contractors individually meet the client. The client then asks each contractor as much information as they think they can get. As soon as these contractors leave the client forgets which contractor said what. The contractors then estimate the job. The client then asks the contractors to e-mail, fax, mail or drop off their pricing estimate. The client then takes the estimates and lays them out on the table. The majority of painting contractors estimates are not very detailed, so the client focuses on one thing &#8211; .Price.</p>
<p>&nbsp;</p>
<p>Whatever little bit of benefits and features each individual contractor was able to give the client was lost in the jumble of the three measure calls. The client completely forgot, who said what. And they don&#8217;t care, because all their friends tell them they have to get the lowest bid. So they take the lowest bid. Most successful contractors know, this technique of choosing, is really not the best way to choose.</p>
<p>&nbsp;</p>
<p>The method of choosing the lowest price does not guarantee a good job. For the most part, the low bidder will not be qualified to do the best job. There&#8217;s a good chance that the low bidder either doesn&#8217;t know how to estimate, or is so desperate for work that they will give it away. Being desperate for work, only tells me one thing, they are very new, or very bad contractors. The other two contractors may or may not have provided a good job. However this method of choice guarantees a bad job. Why? If the job was bid so low, then the contractor may find halfway through the job that if he were to finish the job, he would be working for minimum wage or less. And so he leaves the job in the middle, unfinished.</p>
<p>&nbsp;</p>
<p>Now of course the client is in a bind, embarrassed, angry and puts the blame entirely on the contractor. Hopefully, the client doesn&#8217;t generalize. The problem is when the client talks to his or her friend; they need to justify their position in this mess. So it becomes all contractors are bad. The first mistake was blindly taking the low bidder. </p>
<p>&nbsp;</p>
<p>Their second mistake was not admitting their role in the screw-up. I have heard this story so many times, and wondered so much about how the contractor gets a bad name. And I thought about this, and know that this is the way that it happens, a lot of the time. But what it boils down to be that the client was in complete control of the money creates their own mess. And the most stupid part of the whole thing is that nothing seems to change. Oh yes I know, some people really do know how to choose the right contractor for the job. And I do know that there really are bad contractors. I believe these bad contractors are new and inexperienced, because bad contractors do not last. But I think smart customers and bad contractors are the minority. The majority of customers, unless educated to what makes a good job will always pick the lowest price and guarantee that they will get the worst contractor.</p>

<p>My General Contracting company does not charge for estimates, however some situations I will charge for detailed estimates. Example, an insurance job. The owner calls and ask if we do free estimates &#8211; I say, yes unless it is an insurance estimate.<br />
Then the charge is by the hour because to have a valid insurance estimate for repairs you must list each and every area that needs repaired and insert the materials cost and labor cost for each area.<br />
It is very time consuming.<br />
Just ask your contractor &#8211; If he/she says yes we charge for estimates &#8211; walk slowly backwards out of this deal and find another contractor. I don&#8217;t know of any sane contractor that would charge for a normal estimate.<br />
And by the way &#8211; You don&#8217;t want an estimate, you want an exact price proposal that states everything he/she is to do. Look through some of the same type questions on yahoo answers to see what others say about hiring a contractor.<br />
Check their references, do your homework.</p>

ARMY HAS 50 PROBES INVOLVING CONTRACTORS IN IRAQ/AFGHANISTAN.<br />
From high-$ fraud to conspiracy to bribery to bid rigging. Army investigators have opened up to 50 criminal probes involving battlefield contractors in the war in Iraq, Afghanistan and Kuwait. Senior contracting officials, government officials, residents of other countries and US military personel have been implicated in millions of dollars of fraud allegations. Battlefield contractors have been implicated in allegations of fraud and abuse since the war began in 2003, focusing solely on reconstruction spending in Iraq. Already there have been four criminal convictions.<br />
The new Democratic Congress plans to ramp up oversight of the billions of dollars being spent in Iraq, including dollars awarded to contractors.</p>
<p>I imagine this is one of the reasons Bush has asked for millions more to &#8220;create&#8221; jobs for Iraqis&#8230;.so they can rebuild their OWN&#8230;as they should have from the beginning.

I&#8217;m not quite big enough to purchase a store front or hire massive amounts of people but would like to prepare for the possibility in the future. Can I register with the state without being a general contractor? Thanks for the help.<br />

<p>Get your contractors license. I&#8217;m not going to be critical about you not having one yet. Just do it. Then pay someone else to do the work. Ivory homes is the biggest home builder in Utah by a mile but Ellis Ivory doesn&#8217;t do ANY of the work. You won&#8217;t get big setting your own tile bro.</p>
