Is this wrongful termination or pregnancy discrimination? Please help!!!?

I notified my employer that I was pregnant (about 4 months along) and three weeks later I was terminated due to “unsatisfactory job performance”. Keep in mind I live in Florida which is a right to work state, however, I was never given any warning my job was in jepordy. In fact, every reason that was given to me as a means for the employer to support the dicision to terminate me, is inaccurate if not completely false. I was employed in a male dominated industry, (Construction Equipment rentals-national company) with an outside sales rep’s responsibilities. I have had numerous complaints regarding this employer and after several instances finally called HR to file a complaint. The HR manager I spoke with was one of the names given as a source of support for my termination. There is so much more but this is the jist of my situation. Your help would be appreciated. I look forward to your responses. Many thanks to you all!!!!

I work for a construction contractor. We have files pertaining to jobs we are doing and have done. Some of the jobs we have done were completed 4 years ago, and some 5 years ago. How long should we keep the documents from those jobs?

How long should you keep financial records and other documents?

It’s best to err on the side of keeping, since you never know when you’ll want to refer to an old receipt or statement. A year’s worth of records can fit into a file box or an accordion folder or two.

There are some crucial documents to keep for good. Make copies of birth certificates, Social Security cards, passports, immigration papers, marriage licenses and divorce certificates, stock and bond certificates, real-estate documents, current insurance policies and wills. Keep originals and copies separate from one another in places like a fireproof home safe, bank safe-deposit box, your lawyer’s office, or a trusted neighbor’s house.

Your tax returns — and all supporting documentation — must be kept for at least three years in case of an audit. It’s better to keep them for at least seven years, and best to keep them permanently: There is no statute of limitations for IRS investigations that involve a false or fraudulent return. These documents, which include statements from financial institutions and annual credit-card statements, will also come in handy if you’re applying for a mortgage or major loan.

Hold on to receipts or canceled checks for home-improvement projects and big-ticket items for as long as you own them. You don’t need to keep bills for non-tax-deductible items and utilities for more than a year. Day-to-day receipts for credit-card purchases and ATM transactions can be discarded (shred or tear to be safe) when the monthly credit-card or bank statement arrives.

There are also reasons for keeping nonessentials. For example, referring back to your own medical documents might be easier than going through your insurer. To establish a budget, you’ll need bills and receipts to track your expenditures. And on a more romantic note, receipts from hotels, restaurants, and shops offer information that might otherwise be lost. Years from now, an old receipt can help you find a restaurant you loved in Paris, or the number of the room you stayed in at your honeymoon hotel.

OSHA Regulations In Residential Construction

Problems in Residential Building (OSHA)

Residential construction poses special problems for contractors. In fact, OSHA has currently looking at the fall protection training rules to make differences that better fit the issues institute at residential sites. In the meantime, OSHA has implemented an OSHA Instruction Standard 3.1-Interim Fall Protection Training Compliance Guidelines for Residential Construction until the rule can be modified. Also, OSHA has also teamed up with the National Association of Home-builders (NAHB) to produce a instruction guide that contractors need to use to meet OSHA requirements for residential construction . This toolbox talk will briefly highlight the issue found in that handbook . The instruction guide stresses that if there is ever any inconsistency between it and the OSHA regulations , the OSHA rules will always reign. The instruction guide information should never be considered a substitute for any provisions of any regulation .

Orientation & training

- Do workers in your company receive safety training orientation and training on applicative OSHA standards, company safety requirements, and/or have enough experience to do their work safely?

Personal protective equipment

– Do your workers use all required and provided personal protective products ?

Housekeeping & access around site

– Are all walkways and stairways kept well-defined of trash/debris/cans and other materials such as tools and supplies to prevent fall hazards ? Are boxes, scrap lumber, rocks and other materials picked up and gotten rid of to prevent fire and tripping hazards?

Stairs & ladders

– Is the manufactured and job-specific ladders in good order and have no defects? Are ladders fastened near the top or around the bottom to prevent them from slipping and causing falls?

Scaffolds & other work platforms

- Are all erecting and dismantling trading operations under the direct supervision of your competent person ? Do you ensure all scaffolding equipment are inspected by your competent person before every use?

Fall protection

- Do you use other fall protection systems like slide guards, roof anchors, or mutually exclusive safe work practices when a guardrail system cannot be used?

Workers on Roofs

- When working on a roof with a pitch over 4:12 up to 6:12, are slide guards installed along the roof eave after the starting line three rows of roofing material are installed?

Excavations and trenching

- Do you find the location of all underground utilities by contacting the local utility locating service before digging ? Do you keep the horizontal width of the foundation trench at least 2 ft wide? Make sure there is no earth vibration while workers are in the trench.

Tools & equipment

- Are you inspect tools always to ensure they are safe and Defect-free ? Do you tag and take out broken or damaged tools from the job site ?

Vehicles & mobile equipment

- Do you maintain back-up alarms for equipment with limited rear view or have someone to help guidethem back ?

Electrical

- Do you remove broken or damaged tools and equipment from the work location ?

Fire prevention

- Do you provide fire extinguishers near all welding or soldering locations , or other sources of ignition?

Employee Training Tips

The OSHA rules require you to train all employees to recognize and void unsafe conditions and the rules applicable to his work environment to control or eliminate the hazards (1926.21(b)(2)). Work site safety covers a large number of work spaces . Use this time to implore your workers to be always on the lock out for job site hazards , do not take chances with them, and alert fellow employees and their immediate manager .
