Gone are the days when you could not raise your voice against hazards at work place. You will feel absolutely safe, secure and confident once you have the knowledge of OSHA Rules and their associated benefits. Occupational Safety and Health Administration has been in operation since the year 1971. It has gained remarkable success in preventing work related injuries and illness which may lead to deaths also. OSHA Rules are so designed to protect employees working in hazardous conditions and to ensure them a safe and healthy work environment. All employers are expected to abide by rules under Standard 29 CFR. Anyone in violation of these rules could be punished or penalized. It is extremely important for both employers and employees to have full knowledge of rules and regulations under OSHA. It is an excellent business practice if a manager can follow all guidelines and motivate workers to work in a safe environment.

Standard 29 CFR gives a detailed analysis of all rules and what happens when one doesn’t follow the same. OSHA provides separate guidelines for small business houses which encourage them to maintain safe and healthy work environment alongside meeting all necessary legal requisites. OSHA also gives out details of how Construction Industry, chemical industry, lumbering industry etc should maintain the highest safety standards. The process of recording and reporting injuries and illness is also clearly mentioned. Employers as well as employees must be well aware of it so that none of the rules are flouted. There are separate rules for recording needle stick and sharp injuries, occupational hearing loss, work related tuberculosis cases etc. Simultaneously mentioned is the process of inspection, citation and the penalties. Separate safety and health standards have been set up for Workshops and rehab facilities, agriculture, federal service contracts, shipyard employment, marine terminals etc.

OSHA also clearly mentions that there should not be any discrimination on any grounds between two workers doing the same work. So if you are aware of its discrimination rules you can easily benefit by getting you position rectified legally! OSHA Rules also lay immense emphasis on technical assistance to be provided to employees. All machines must be thoroughly checked and inspected. The process of using them, handling sudden start ups and handling other emergencies should be thoroughly stated to the employees. On their part employees must understand and implement it thoroughly. As an employee you must remember that your employers’ lawyer will leave no stone unturned to prove you carelessness and negligence while working. As the saying goes it is better to be safe than sorry. It is important to know your machine as well as all OSHA rules to avoid mishaps and untoward circumstances.

If employers follow OSHA standards their business becomes more economical. After all when you follow these standards you can avoid hefty legal expenses. Your employees are provided a safe environment so you can forget the over bearing medical expenses, leaves, low worker turn out, labor unrest etc. You can bury the problems in the past if you comply and follow OSHA rules and regulations.

can a company make an employee pay a fine for an OSHA violation?

I work in the Construction Business and was recently inspected by OSHA. The company I work for was fined $6900.00 for non-compliance with OSHA regulations. Now, almost 3 months later I am having $25 taken out of my check every week for “osha fines”.

NO you do not have to pay an OSHA fine. The fine was written to a Company and they are responsible.

Can I be punished or discriminated against for exercising my rights?

The OSH Act and other laws protect workers who complain to their employer, union, OSHA or other government agencies about unsafe or unhealthful conditions in the workplace or environmental problems. You cannot be transferred, denied a raise, have your hours reduced, be fired, or punished in any other way because you have exercised any right afforded to you under the OSH Act. Help is available from OSHA for whistleblowers. But complaints about discrimination must be filed as soon as possible–within 30 days of the alleged reprisal for most complaints.

It is your responsibility to follow safety rules and tell if you know of a hazard, but not to pay a fine. On the inverse to they let you share the profits in the company?

Also for most states it is against the law for an employer to remove money from your check without your written consent. I would suggest calling your Labor Department Wage/Hour Investigation Unit and discussing it with them.
