is it legal that my company took $50 off my paycheck for this reason?
I work for a delivery company in Michigan as a contractor. My job is to pick up different food orders from different local restaurants and deliver them to designed customers. My rate is $3 per delivery plus tips. I recently have a problem with my company. One day the restaurant gave me the wrong food and I picked it up delivered it, and in the end of the month, when I received my paycheck I realized $50 was short in what I was supposed to make. I asked the manager he said I made a mistake on that food order, and the restaurant had to remake it food, so the wrong order–which costs $50–has to pass on me, and they took this $50 off my paycheck without telling me before. I never knew this policy before in any written form or in the contract. So my question is, is it legal that the company took this $50 from my paycheck even though the company has no such a policy announced before?
It would have been nice if they had informed you that same day or the next that you delivered the wrong order and that they were going to dock you for this. My only suggestion is that in the future you verify the order before delivering it to the customer.
My question is, if you took the wrong order, then that order should have gone to someone else, so in effect, they would have had 2 wrong orders? So could those 2 have been switched and gone to 2 people?
You are only a contractor, so they can pretty much do what they want. Sometimes customers will complain to get free food from a restaurant and this could have happened to you. I have been in restaurants where a customer has actually eaten an entire meal, then complain it was awful, then they get the meal for free.
So I suggest you double check everything from now on, by verifying the food/customer at the restaurant and also when you deliver it to the customer that it is correct, and keep a log, just in case this should happen again, since it could be the restaurant’s fault and they are passing it on to you.
